The requested conditional water storage rights for New Horizon Mine Pond Nos., 008 <br />through O1S, inclusive, will be used by Western Fuels for irx'igation, stockwatering and <br />mining uses, including without limitation dust suppression and sediment control in and <br />around the New Horizon Mine located near Nucla, Colorado.. The subject conditional <br />appropriations axe part of a unified and integrated water supply system for' the provision <br />of water to the New Horizon Mine, which system also includes the water rights for New <br />Horizon Mine Pond Nos.. 001, 002, 004, 005 and 006 as decreed in Case No, 94CW074, <br />and the plan for augmentation for the New Horizon Mine as decreed in Case No.. <br />88CW055, or as may be subsequently amended by this Court. The Referee finds that the <br />subject conditional water rights together with the water rights decreed in Case Nos. <br />88CW455 and 94CW474, are part of a svngle "project or integrated system" within the <br />meaning of C.R.S.. § 3'1-92-301(4)(b) for purposes of diligence deterrxxinations.. <br />Iherefore, with respect to future diligence applications, work on one feature of the <br />integrated water supply system for• the New Horizon Mine shall be considered in finding <br />
