Warranty, Financial Warranty Letter of Credit and Irrevocable Letter of Credit
Deaz Mr. Russell:
On March 28, 2008, the Division of Reclamation, Mining and Safety received a Succession of Operators application, a
Performance Warranty, First National Bank Irrevocable Letter of Credit No. 50, in the amount of $45,478.00, and a Financial
Warranty Letter of Credit for the Spotted Burro Pit, Permit No. M-1979-192. The Division is returning the Irrevocable Letter
of Credit for the following:
The Division requires the letter of credit be issued in language approved by the Mined Land Reclamation Board
(NLRB). On March 12, 2008, the NLRB approved an amendment to the Irrevocable Letter of Credit template, which
quotes UCP600 regulations, rather than UCPS00 regulations. Please find this template enclosed for your bank's use
in correction.
The NLRB may recover the necessary costs, including attorney's fees or fees incur ed in foreclosing on or realizing
the collateral used in the event an Irrevocable Letter of Credit is forfeited. The face amount of this Letter of credit
shall be increased by five hundred dollazs ($500.00) to cover these costs. Please note that the required surety amount
for this operatio~z is $45, 478.00. Therefore, the face amount of this Irrevocable Letter of Credit should be
$45, 978.00.
Upon correction, please return the Irrevocable Letter of Credit to my attention.
