Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division proposed to transfer the Golden Eagle Mine coal mining and reclamation permit, No. C-1981- <br />013 to New Elk Coal Company, LLC from Basin Resources, Inc. on March 28, 2008. The underground coal <br />mine is located in Las Animas County, approximately 20 miles west of Trinidad, Colorado. The coal to be <br />mined is under Federal and private ownership and the surface is under Private ownership. A copy of the <br />proposed decision is enclosed. <br />In accordance with Rule 2.08.6(6), any person with an interest which may be adversely affected by the <br />proposed decision may request a formal hearing before the Mined Land Reclamation Board within thirty (30) <br />days of this notice by the Division. <br />If you have any questions, please contact me. <br />Sincerely, <br />Kent A.
