Erickson <br />Division of Reclamation, Mining and Safety <br />Page 2 of 2 <br />March 21, 2008 <br />located in close proximity to municipal wells in and around the Town of San Luis, the issues <br />involved are of paramount importance to the community. <br />3. Also involved are general water chemistry issues in and around the mine site, the <br />Salazar Ranch and the Town of San Luis, as well as the impact of constituents on the soil and <br />plant life as it travels from its point of placement on the Salazar Ranch to the aquifer. <br />4. There are further hydrologic and geologic issues involved in .the nature and <br />characteristics of the underlying aquifers. The recent Rio Grande Decision Support System <br />studies (RGDSS) provide some help with the factual considerations, but information is limited in <br />this region of the Valley which makes the issues more difficult to deal with, and particularly so, <br />with a limited amount of time. <br />5. BRMI has had the ability to conduct its own investigation and studies prior to <br />filing AM-03. With the hearing date set for mid-June, 2008, these Opposers are left with only <br />approximately three months to prepare for a hearing that will be very complex in nature. This <br />time period is not adequate for preparation for these Opposers. In addition, Mr. Scott Mefford, a <br />registered engineer, has been retained by the Opposers as an expert witness. He is out of the <br />country on June 11 and 12, and will not be available for the hearing. Mr. Mefford's presentation <br />is a material part of the Opposers presentation. The undersigned has just learned of Mr. <br />Mefford's unavailability. <br />In the interest of allowing a fair and full presentation of the position of all parties, these <br />Opposers request a continuance of the June 11-12, 2008, hearing dates to a date and time <br />consistent with the availability of witnesses' and counsels' schedules. <br />Respectfully submitted, <br />~~ <br />John C.
