The Costilla County Conservancy District, <br />the Board of County Commissioners of Costilla County and the Montez Ditch filed a statement <br />opposing the application on February 22, 2008. Mr. Edwin Lobato and our firm represent these <br />Opposers. On behalf of these Opposers, we respectfully request that the hearing date be vacated <br />and reset to a Iater date to allow for adequate preparation by those Opposers for the issues <br />involved at the hearing; Also, one of our expert witnesses is out of the country during the dates <br />of June 11 and 12, 2008. <br />In support of our request, please note the following: <br />1. The issues involved in Battle 1Vlountain Resources, Int.'s ("BMRI") amended <br />application in AM-03 are complex. The modeling issues submitted by Mr. William Lytle <br />involve groundwater modeling studies of the hydrology and geology in a small area in southern <br />Costilla County. <br />2. The modeling issues involve groundwater flows and the manner and mode a <br />constituent moves in the groundwater, along with its potential impact on the health of both <br />human beings and animals. Since the point of injection of the constituents in the groundwater is <br />
