• • <br />withdrawal is proposed, the perforated intervals for the well casing, and <br />the zones where cement grout will be placed. Any decree approving a <br />plan fior augmentation that allows a new withdrawal of ground water <br />from the Confined Aquifer System shall require that the well shall not <br />be deepened beyond the depth specified by the applicant without <br />approval of the State Engineer. <br />2. Except as provided in Rule 6.B.2.d, to prevent injury to the vested <br />water rights of others, the applicant for a new withdrawal of ground <br />water from the Confined Aquifer must change the point of diversion of <br />or permanently retire an existing vested water right or rights to <br />withdraw ground water from the Confined Aquifer with historical <br />withdrawals from the Confined Aquifer equal to the new, increased, or <br />additional supply of ground water to be withdrawn from the Confined <br />Aquifer. <br />a. The vested water right or rights to be changed or permanently <br />retired must be at a location such that the water to be made <br />available by permanently retiring the right or rights will prevent <br />injury to the vested water rights of others from a new withdrawal. <br />There shall be a rebuttable presumption that any vested water right <br />to be changed or retired that (1) is located in a different hydrologic <br />zone, as shown on the map attached as Exhibit 1, than the point of <br />diversion of the new withdrawal, or (2) withdraws from a different <br />10 <br />
