V. Status of Problem Resolution <br /> The following items concern problems identified at previous inspections. <br /> Problems are classified into two categories. These are: (1 ) problems <br /> resolved; and (2) operator delinquent. The date that the problem is <br /> resolved or the date that the operator is deemed delinquent is to be <br /> clearly stated. <br /> RESOLUTION IN PROGRESS <br /> 017-83-8. Remove the coal that is beyond the berm on the southwest <br /> corner of the Mine No. 2 coal stockpile as soon as the stockpile is <br /> sufficiently small enough to facilitate a removal of the fugitive coal. <br /> PROBLEM RESOLVED <br /> 017-83-13. The operator has cleaned the slurry from the undisturbed <br /> area outside the slurry pond west of the wash plant and <br /> rebuilt the embankment to provide a minimum of freeboard. <br /> 017-83-14. The operator has cleaned sediment pond 006 as requested. <br /> 017-83-16. The operator had cleaned the drainage ditch below the north <br /> side of the Mine No. 1 stockpile. However, the drainage <br /> ditch had become plugged again with fugitive coal from the <br /> stockpile. <br /> 017-83-21 . The operator has regraded the newly established topsoil <br /> stockpile above the Mine No. 1 coal stockpile and erected a <br /> marker, as requested. <br /> 017-83-22. The operator has removed the material tracked onto the <br /> access road from the preparation plant by the front gate. <br /> 017-83-03. The operator has built up a berm along the outside edge of <br /> the Mine No. 4 road from the powder magazine down. <br /> 017-83-24. The operator has diverted the overland flow from the arctic <br /> circle pump pond into Dutch Creek. <br /> 017-83-25. The operator has constructed a berm along the edge of the <br /> pad east of the MSHA trailer at Mine No. 1. <br /> 017-83-26. The operator has cleaned the upper 2 sediment ponds below <br /> the refuse pile. <br />
