Pavlik <br />Office of Mined Land Reclamation <br />Division of Minerals and Geology <br />Department of Natural Resources <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />Re: Bond Reduction Application <br />Permit No. C-81-025 <br />Dear Ms. Pavlik: <br />The Division Decision and Findings Regarding <br />Technical Revision No. 12 to the Permit ("TR-12") provided <br />that the Diamond-A Parcel, a substantial component of the unit <br />train loadout facility of the North Thompson Creek Mine, would <br />be eligible for a final bond release upon the completion of <br />(1) removal of two concrete conveyor footers on the east bank <br />of the Roaring Fork River, and (2) implementation of the <br />residential and industrial post mining land use (i.e. <br />commencement of excavation or other construction activities <br />related to the post mining land use). In a letter dated July <br />10, 1992 addressed to Kevin H. Kelley of Holme Roberts & Owen <br />LLC, Shawn E. Smith of the Office of Mined Land Reclamation <br />confirmed that the concrete footers had been reclaimed. <br />As evidence that Aspen Glen has commenced <br />construction activities on the Diamond-A Parcel, enclosed as <br />per agreement with the Division are photographs of <br />construction activity, together with a press release from <br />Aspen Glen which states that such construction activity is <br />occurring on the Diamond-A Parcel. <br />Now that these final requirements of TR-12 have been <br />met, this application for a partial bond reduction requests a <br />full and final release of bond and liability requirements <br />attributable to the Diamond-A Parcel. Such full and final <br />release will reduce the required bond amount for the entire <br />loadout facility from $92,720 to $15,453 (the amount necessary <br />to revegetate the slope within that portion of the loadout
