ORIGINAL - PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-19An--24d <br />INSPECTION DATE: A/l/08 INSPECTORS INITIALS: RK <br />OBSERVATIONS <br />The Division conducted an inspection of the site on August 1,2008 in response to a <br />citizen's complaint. <br />On July 28, 2008, the Division received an e mail from Mr. Carl Poch a resident in Cripple <br />Creek STATING, "The entire hillside facing Cripple Creek is capped with overburden Mesa's <br />visible everywhere. The mine 24/7 continues to dump on these huge piles and they can no <br />longer remain stacked neatly. Rocks are cascading down the hill side into the area <br />proposed for mining in Amendment # 9.Additionally about one third of the way down the <br />hillside the mine has done some exploratory work and has a very large pile of rock". <br />The Division met Mr. & Mrs. Poch at their resident in Cripple Creek, which has a visible <br />VIEW of the CC&V'S PERMIT AREA ALONG its Western Extension. Mr. and Mrs. Poch's property <br />is located west of the Mine property. From MR & Mrs. Poch's property looking East the old <br />reclaimed and un reclaimed portion of the Iron Clad Globe Hill old pads and a portion of <br />the Western Extension of the Approved Squaw Gulch overburden storage areas are visible. <br />After a brief discussion about the mine and its operation, MR. Mrs. Poch drove me to the <br />Cripple Creek City Cemetery and pointed out the Squaw Gulch overburden area and that they <br />believed that the operator CC&V was adding over burden in the area. They were informed <br />that the Squaw Gulch overburden area is approved under amendment # 8 to store overburden <br />and that by the time the different phases are completed it will reach to the bottom of the <br />valley. Below the valley there is a very large sediment pond to handle the storm water <br />around the storage area and no rock has ever slid off site in this area. Granted when <br />rocks of different size are end dumped from such heights one or two will travel further <br />than the angle of repose, but they are always with in the permit and affected areas and <br />ones the storage areas capacity is reached all storage areas will be reclaimed as approved <br />in the Amendment. No rock slides have ever been noted outside the affected and permit <br />areas. <br />In fact from the cemetery where we were viewing the overburden storage area, one can't <br />tell a rock slide due to the natural cover and the distance. Mr. Poch was provided copies <br />of the comments from the State Historical comments that was requested at our meeting on <br />7/27/08 by some of the objectors.
