Dear Mr. Gebhart:
On July 28, 2008, the Division of Reclamation, Mining and Safety received a Succession of Operators application, a Performance
Warranty and a $144.00 Succession of Operators application fee for the Green Bros. Pit No. 2, Permit No. M-1995-030. The
Division is returning the Succession of Operators Application and Performance Warranty for the following:
Succession of Operators Application:
The Division requires the successor operator to initial and date Option A on page 1 when no financial warranty is
initially submitted.
The Division requires the successor operator company name listed throughout this document match the company name
listed with the State of Colorado Secretary of State's office (i.e. "McAtee Construction Company" rather than McAtee
Construction Co.").
The Division requires the company name listed within the Notary for Permittee section on page 5 match the company
name listed with the State of Colorado Secretary of State's office (i.e. "Green Bros., Inc." rather than "Green Bros.
Inc."). Please note the comma between "Bros. " and "Inc. ". Please have your notary make and initial this correction.

The Division requires the operator company name listed throughout this document match the successor operator
company name listed on the Succession of Operators Application (i.e. "McAtee Construction Company" rather than
