As we discussed, I am the Park County Attorney. As we also
discussed, Park County has been diligent in addressing the issues raised in DRMS's letter of violation. You
mentioned that my July 11, 2008 letter to DRMS had not made its way to your desk so I attach another copy for
you convenience. I have also followed your e-correspondence with David Kintz, Park County Road and Bridge
Director and believe that this matter will be resolved shortly with some re-grading of the subject property.
The purpose of this e-mail, however, is to request that the hearing scheduled for the August 13-14 meeting of
the MLRB be vacated or continued. When I spoke with Tony Waldron last Friday he stated that he had no
objection to continuing the matter and my sense was that you concurred. Hopefully, no hearing will be required at
all, but I do need to assure that the August hearing will not occur within the next two business days since I will be
absent from my office beginning August 5, returning August 12, attending my daughter's wedding in Montana. An
electronic confirmation from you office will certainly suffice.
Finally, I wanted to thank you and Mr. Waldron for your courtesy and consideration in this matter.
Herbert C.
