Cattany <br />Division Director <br />L/ Natural Resource Trustee <br />Re: October Ore Pile Reclamation-110d application, Reference No. M-2008-050, Preliminary <br />Adequacy Review. --- <br />Dear Mr. Carter, <br />The Division of Reclamation Mining and Safety has done a preliminary adequacy review of the <br />above referenced application with an amendment. It is important to note for the permit file that <br />the proposed operation is for the removal, of an existing exposed pre-law ore pile and no other <br />excavation. The proposed project will remove the ore pile which is approximately 7,500 tons and <br />reclaim the footprint of the pile and work area. Staff recognizes that the project barely meets the <br />definition of a mining activity let alone a Designated Mining Operation. Overall, the removal of <br />the ore pile can be viewed as an immediate environmental benefit for the area. Therefore, normal <br />requirements for a Designated Mining Operation appear to be excessive at this time. <br />A review of the application by staff notes only one issue. The issue is the temporary storm water <br />controls necessary to prevent sedimentation from the ore storage removal activities leaving the <br />site. Since the site is small and'the duration of the project is so short temporary measures such as <br />silt fencing should be more than adequate. The Division is requesting a commitment to placing <br />silt fencing around the parameter of the permit boundary including truck turning and loading <br />areas. The silt fencing shall be maintained at all times for the duration of the project and removed <br />during reclamation. Staff will consider the fencing as being an adequate protection barfier for the <br />cultural site off the permit boundary as well. <br />With confirmation of the commitment, staff will calculate the reclamation liability for the project <br />and finish the review process.
