• No surface disturbing activities shall occur within %Z mile of active raptor nests between <br />May 15th and July 15th. No surface disturbing activities at any time within 1/4 mile of <br />active raptor nests. Primary species of concern include Peregrine Falcon and <br />Ferrruginous Hawk, but all raptors should be considered. <br />• Migratory Birds: Breeding bird surveys shall be conducted for activities which are <br />planned to occur between May 15 and July 15. All migratory bird nests for species <br />indicated above shall be avoided by project activities. <br />• To protect faded midget rattlesnake, do not harm or kill snakes unless human health or <br />safety is at risk. <br />• To protect wintering Elk and Deer, no surface disturbing activities shall occur from <br />December 1St through April 30th <br />• Sensitive plants will be avoided by project activities. <br />• BLM concurs with the bonding recommendations of the Colorado Division of <br />Reclamation, Mining and Safety (CDRMS). Operations may begin when the bond is <br />filed with CDRMS and a copy of the bond is submitted to this Office. <br />• Be advised that wildland fires can occur at any time, but especially during our summer <br />fire season. As the operator of a minerals related project, it is your responsibility to take <br />every reasonable precaution against initiating accidental fires. As the operator you may <br />be held liable for the costs associated with fighting a fire your operations have caused. <br />Also, it is the policy of the BLM to allow some natural caused fires to burn as part of our <br />"Fire Use" policy. If a fire use wildfire presents a safety issue with your operation, you <br />may be asked or even ordered to evacuate the area. Please comply with all fire <br />management direction when instructed to do so. <br />Your Notice is complete, the operation will not cause unnecessary or undue degradation to the <br />public lands and it contains all the information required by BLM surface management <br />regulations at 43 CFR 3809.301. Your notice remains in effect for 2 years from the date of <br />this letter, unless extended under 43 CFR 3809.333 or unless you notify BLM beforehand that <br />operations have ceased and reclamation is complete. BLM will conduct an inspection to verify <br />whether reclamation has been completed before recommending bond release to the Colorado <br />Division Reclamation Mining and Safety (CDRMS). On or before the expiration date, the Field <br />Manager must be given written notice if you intend to continue operations under the terms of the <br />existing Notice for an additional two (2) years.
