Clear Creek District Water Providers, LLC Divis <br />109 <br />Minerals antl GevIDDY <br />To Whom it May Concern o».; <br />: <br />Enclosed please find a completed application package for the above referenced project- <br />There are several items of note: <br />The entire property is owned by Phillip and Kathleen Wolf and it consists of one <br />large parcel of approximately 522 acres and a smaller parcel of approximately 4 <br />acres on the southwest side of holding. We have provided a current title <br />commitment for the larger parcel and, since the smaller parcel was purchased in <br />April of this year, a copy of the Warranty Deed for that parcel. <br />The Wolf's own the entire property under this application and also hold all of the <br />original patent rights to include all mineral deposits. <br />There are only three man-made structures within 200 feet of the disturbed area <br />as planned. it is important to note that the 3 structures are within 200 feet of the <br />access road only and not within 200 feet of the actual mine area. There are no <br />structures within 200 feet of the mine area. We have begun the 200-foot <br />notification and agreement process and will submit these as soon as they are <br />completed. The structures include CDOT owned Colorado Highway 119, Public <br />Service Company power and telephone lines, and a sewer line that is under <br />construction owned by the Blackhawk Central City Sanitation District. Since <br />these agreements or the alternative engineered slope stability analysis are not <br />completed as of this time we have included a signed affidavit by the applicant <br />that no disturbance will take place until the agreements or slope stability analysis <br />are completed and approved by the DMG. <br />Please also note that the applicant, Clear Creek Water Providers, LLC is a limited <br />liability company and not a corporation. Therefore there is no corporate secretary nor a <br />corporate seal. Mr. Lembke is the only manager of the LLC and he has signed the <br />application. <br />0012
