Permit Revision No. 10, Expand B-Seam Mine Plan to the North, Fifth Adequacy Review
Dear Mr. Bear:
The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of
Bowie Resources LLC's (BRL) responses dated June 25, 2008 to the Division's fourth adequacy review
letter dated June 12, 2008 for Permit Revision No. 10 (PR-10). Only two issues remain unresolved, ground
water monitoring wells (item number 2) and any further comments from the Colorado Division of Water
Resources (items numbered 32 and 36). The Division is expecting comments from the Colorado Division
of Water Resources shortly and will forward them to BRL when they are received. The following is the
current status of the issues:

Rule 2.03
The Division has conducted an Applicant Violator System (A VS) computer check of the Bowie No.
2 Mine permit. The recommendation is to "issue ". The Division will conduct similar AVS checks
at the time of the Division's proposed decision and at issuance time for PR-10.
BRL did not have to respond to this comment.
Rule 2.04
2. As indicated in the PR-10 application, BRL intends to install additional groundwater monitoring wells
in Hubbard Creek north of the proposed mine plan area. The Division concurs, because of the northern
extension ofmining BRL will need to add additional down gradient groundwater monitoring wells to the
hydrologic monitoring plan. Please provide the Division with the proposed plan for well installation
prior to drilling and constructing the new wells. Also, please update the appropriate permit application
text, including the completion summary table. Groundwater monitoring of each aquifer above, within
and, ifpotentially impacted, below the lowest coal seam to be mined will be required in accordance with
Rule 2.04.7(1).
