Box 483 Division Director <br />Natural Resource Trustee <br />Paonia, Colorado 81428 <br />RE: Bowie No. 2 Mine, Permit No. C-1996-083, Bowie Resources LLC <br />Permit Revision No. 10, Expand B-Seam Mine Plan to the North, Fifth Adequacy Review <br />Dear Mr. Bear: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of <br />Bowie Resources LLC's (BRL) responses dated June 25, 2008 to the Division's fourth adequacy review <br />letter dated June 12, 2008 for Permit Revision No. 10 (PR-10). Only two issues remain unresolved, ground <br />water monitoring wells (item number 2) and any further comments from the Colorado Division of Water <br />Resources (items numbered 32 and 36). The Division is expecting comments from the Colorado Division <br />of Water Resources shortly and will forward them to BRL when they are received. The following is the <br />current status of the issues: <br />Division's Adequacy Review Letter Dated May 18, 2006 <br />Rule 2.03 <br />The Division has conducted an Applicant Violator System (A VS) computer check of the Bowie No. <br />2 Mine permit. The recommendation is to "issue ". The Division will conduct similar AVS checks <br />at the time of the Division's proposed decision and at issuance time for PR-10. <br />BRL did not have to respond to this comment. <br />Rule 2.04 <br />2. As indicated in the PR-10 application, BRL intends to install additional groundwater monitoring wells <br />in Hubbard Creek north of the proposed mine plan area. The Division concurs, because of the northern <br />extension ofmining BRL will need to add additional down gradient groundwater monitoring wells to the <br />hydrologic monitoring plan. Please provide the Division with the proposed plan for well installation <br />prior to drilling and constructing the new wells. Also, please update the appropriate permit application <br />text, including the completion summary table. Groundwater monitoring of each aquifer above, within <br />and, ifpotentially impacted, below the lowest coal seam to be mined will be required in accordance with <br />Rule 2.04.7(1). <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
