CC&V has worked hard to reach out to the City of Cripple Creek <br />and its City Council to discuss the Mine Life Extension (MLE) both before and <br />after submittal of the MLE permit applications with Teller County and State of <br />Colorado. Based on our discussions and meetings with Mayor Baader and <br />others, we were lead to believe that matters were being appropriately resolved <br />and that constructive dialogue would continue. But the letter submitted by Mayor <br />Baader and several council members on June 5th addresses many new matters <br />and raises significant demands for which many are without any legal justification. <br />CC&V would like to try to continue to maintain a constructive dialogue with the <br />City and in that spirit we provide this response. <br />As an initial matter, it is unfortunate that the City of Cripple Creek believes they <br />could not have anticipated the impacts of mining when the current permit <br />boundary and zoning was approved in 2000. As for each of the specifically listed <br />points and demands, CC&V provides the following information. <br />Point One - National Historic Landmark <br />CC&V has conducted surface mining activities on lands it owns near or in the <br />NHL since well before designation of the area. In fact the US Department of <br />Interior and the US Geological Survey, were encouraging exploration and <br />potential mining activities in the Cripple Creek area in 1961. The activities <br />already approved and those proposed by the MLE are a continuation of the <br />surface mining activities that pre-date the establishment of the NHL.
