Larne offStLuctures: The four structures that are the subject of this Ruling and Decree are <br />located within the Kingfisher Point Natural Area, and are collectively referred to as the <br />"Kingfisher Point Ponds." The four structures are individually designattA as follows: <br />a. Gadwall Pond <br />b. Canvasback Pond <br />C. Goldeneye Pond <br />d. Dragonfly pond <br />?. I e?Gl Description: The Kingfisher Point Ponds are located in the W 1/2 of Section 17 <br />and the E 1 /2 of Section 18, both in Township 7 North, flange 68 West, 6th P.M., Larimer <br />County, Colorado. The four structures were originally excavated as gravel pit mines. As such, <br />the structures do not have dams. The specific locations of the four structures are depicted on the <br />rnap attached as Figure 1. All four structures are located within the city limits of Fort Collins. <br />The structures, which are unlined off-channel ponds that were excavated in the alluvium of the <br />Cache la Poudre River Jill by ground water infiltration from the alluvium of the Cache La Poudre <br />River, and do not have filler ditches. As such, they are, collectively, a "well" as defined in <br />C.R.S. Sections 37-90-103(21) and 37-92-103(14), which diverts tributary ground water into the <br />Kingfisher Point Ponds for the beneficial uses described herein. <br />Source: Ground water tributary to the Cache La Poudre River. <br />4. Date oi'Appropriation:.Iunc 2, 1992. The appropriation was initiated by gravel mining <br />and issuance of a well permit for the four structures. Fort Collins purchased the property upon <br />which the Kingfisher Point Ponds are located subsequent to the cessation of the gravel mining, <br />fir use as a recreation and natural area. The Kingfisher Point Natural Area was opened to the <br />public in 1998. and -,voter has been applied to the beneficial uses listed in Section 6, below, since <br />that i.lnlc. <br />5. Amount: The capacities of water that the Kingfisher Point Ponds may contain at the high <br />eater line for the beneficial. uses set forth in Section 6, below, are as follows..
