(SCC) enclosed is an application for a <br />technical revision to change the postmining land use at the Overland Conveyor. <br />SCC is submitting this application as a "technical" revision because the proposed <br />land use is not subject to the Division's rule 2.05.5(2)(d). The goal of this <br />proposed revision is to change the post mining land use at this area from fish and <br />wildlife to industrial. The revised documents in this submittal are based on the <br />assumption that this land use change application will be approved prior to Permit <br />Revision 4 (PR-4), the land use change application that has been submitted for <br />the Unit Train Loadout, Rail Spur and a portion of the Overland Conveyor. <br />All structures and associated facilities of the overland conveyor have been <br />removed and final grading and revegetation was completed in 2004. Since <br />completion of reclamation in this area, the Union Pacific Railroad's (UPRR) <br />employees and contractors have continued to use this site for access to the rail <br />for maintenance and to store materials and equipment when repairs are being <br />performed on the rail. Since SCC has had little to no control as to how the UPRR <br />has been using the land, and taking into consideration that this area was <br />classified as industrial prior to mining, we believe that the postmining land use of <br />industrial is appropriate.
