III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division) on 14 July 2008. The weather was clear and the mine site <br /> was dry during the on-the-ground inspection of the site. <br /> Availability of Records <br /> See attached DRMS Availability of Records. All records were located and inspected at the Routt <br /> County Courthouse in Steamboat Springs, CO. <br /> Signs and Markers <br /> The mine I.D. signs were in place at the entrance of the Old Tipple Road entering the mine area to the <br /> south, the access road off of County Road 78 and the North Road entering the mine area from the <br /> north. All mine I.D. signs appeared to be in compliance with all required information displayed and no <br /> problems noted. <br /> Roads <br /> The Old Tipple Road, North Road, Lower Moffat Road, Center Ridge Pond Road, West Ridge Pond <br /> Road, and West Ridge Road were dry. All roads appeared to be stable and in compliance with no <br /> problems noted at the time of the inspection. <br /> Hydrologic Balance <br /> The Moffat Pond was full of clear water with a small amount of discharge noted. A small amount of <br /> water was flowing into the pond from the springs on the south end of the pond. The embankments <br /> appeared to be stable and well vegetated with no problems noted. The primary spillway appeared to <br /> be functioning as permitted and the emergency spillway appeared to be in compliance with no <br /> problems noted. <br /> The Center Ridge pond was full of water with a small amount of discharge at the time of the <br /> inspection. The embankments appeared stable and in compliance, at the time of the inspection the <br /> primary spillway was functioning as permitted and the emergency spillway was in good condition with <br /> no problems noted. <br /> The West Ridge Pond was full of water with a small amount of discharge at the time of the inspection. <br /> The lower plunge pool of the West Ridge Pond was holding water at the time of the inspection. The <br /> embankments appeared stable with no problems noted. The primary spillway was functioning as <br /> permitted at the time of the inspection. <br /> The permanent diversion ditch from the West Ridge Pond to the Center Ridge Pond contained water <br /> and was discharging with the Center Ridge Pond. The Flume located between the Center Ridge Pond <br /> and the river was flowing at 0.2 cfs. <br /> The four Moffat down drains appeared to be in good condition with no problems noted. No water was <br /> observed flowing in the drains at the time of the inspections. <br /> The string-of-pearls permanent drainage channel contained water at a majority of the check dams. No <br /> problems were noted and the drainage appears to be functioning as designed. <br />
