III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> Terror Creek Company. There was no activity at the loadout during the inspection. <br /> Signs and Markers <br /> The mine ID signs were on their posts at the main entrance off of old highway 133,the east side entrance and <br /> along the road next to the railroad tracks.The required information was on each sign. Permit boundary markers <br /> were up around the loadout site. <br /> Roads <br /> The paved main entrance road was in good condition.No coal dust was on the highway at the entrance. The <br /> graveled east entrance road was also in good condition. The east entrance gate was open.The light use road <br /> along the tracks was passable. <br /> Facilities <br /> There was a moderate amount of stockpiled coal on the facilities bench.No railcars were being loaded,nor were <br /> any coal haul trucks being unloaded during the inspection.No indications of fugitive dust were observed. There <br /> were no leaks at the fuel facility.No problems were observed at the mine office, substation, loading and <br /> unloading structures and the material storage area. <br /> Hydrology <br /> The sediment control system was in place and functioning properly.The east pond was dry. The pond spillways <br /> were operational,with the primary discharge pipe valve in the closed position.The pond inslopes and outslopes <br /> were stable. The pond embankment was well vegetated. The west side dugout pond was dry. <br /> Culverts were clear and collection ditches had sufficient capacity. The straw bales and silt fence were in place <br /> along the railroad track small area exemption. <br /> Topsoil <br /> The west side topsoil stockpile was well vegetated,although the vegetation on the south facing slope had turned <br /> brown.The collection and diversion ditch/berm was in place. The east side topsoil stockpile had a moderate <br /> vegetative cover. The collection ditch and the diversion ditch associated with the east topsoil stockpile had <br /> sufficient capacity.Topsoil signs were up on both topsoil stockpiles. <br /> Records <br /> The required records were in the mine loadout office and were up to date. <br /> c:/word/terror/insp0708 <br />
