Russell Means
Environmental Protection Specialist
Division of Reclamation, Mining and Safety
Department of Natural Resources
1313 Sherman Street, Rm. 215
Denver, CO 80203

V
?'JUL 3 1 2008
FlFrini?9 arch safely
Re: Nuvemco LLC, October Ore Pile Reclamation (File No. M-2008-050) (CHS #52966)
Dear Mr. Means:
Thank you for-your correspondence dated July 21, 2008 (received by our office on July 23,, 2008)--
regarding the subject project.
A search of the Colorado Cultural Resource Inventory database indicates that three cultural resource
surveys have been conducted within or near the proposed permit area. From these surveys, 46 sites
have been identified within Sections 4, 5, 8, and 9 of Township 50N, Range 19W. From the map
provided, it appears that the proposed project area is centered on the intersection point of these four
sections. If this is accurate, it does not appear that any of the previously recorded sites will be
impacted. However, if this is not accurate, our office recommends that the proposed mining activities
should avoid adverse effects to sites that have been determined eligible or those for which eligibility
remains unevaluated for the National Register of Historic Places (NRHP). If site avoidance is not
possible, we recommend further consultation with our office in order to identify options to avoid,
minimize, or mitigate the adverse effect to the sites.
Should human remains be discovered during mining activities the requirements under State law CRS
24-80 part 13 apply and must be followed.
Please note that our review of your project is expedited when you indicate the extent of the proposed permit
area on a legible portion of the appropriate and clearly identified 7.5 minute USGS topographic map.
Thank you for the opportunity to comment. If we may be of further assistance, please contact Shina
duVall, Section 106 Compliance Coordinator, at (303) 866-4674 or shina.duvallnchs.state.co.us.
Sinc
Edward C.
