Cattany <br />Division Director <br />Natural Resource Trustee <br />Twentymile Coal Company (TCC) submitted NPDES Discharge Monitoring Report (DMR), for May 2008, <br />Colorado Department of Public Health and Environment CDPS permit no. CO-0027154 and CO-GO72758, <br />on June 30, 2008. <br />Four outfalls; 002A (Pond T), 003A (Pond B), 005A/MON 5 (Pond D), and 008A (Pond G) discharged <br />during May 2008. TCC reported one exceedance for TSS for Outfall 008A. TCC reported this elevated <br />TSS value of 98 mg/L as a result of snowmelt. Subsequest TSS samples of Outfall 008A discharge were <br />below the TSS limit of 70 mg/L. <br />Permit CO-GO72758 is an impoundment designed not to discharge (6MN pond). Exceptional snowpack in <br />Spring 2008 resulted in TCC needing to pump from the 6MN pond into a tributary of Fish Creek. TCC <br />consulted with CDPH&E prior to pumping (on site discussion with TCC personnel) and collected water <br />samples of effluent. No parameter exceedances were recorded for the May 16 and 17, 2008 pumping <br />event. The cover letter and the DMR form indicate that the 6MN pond was pumped to a tributary of Foidel <br />Creek. The Division believes that this pond would discharge to a tributary of Fish Creek. Please correct <br />this on future submittals. <br />The reports are in compliance with Rule 4.15.13(2)(iii).
