Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division has reviewed CAM Mining LLC's (CAM's) 2007 Annual Reclamation Report <br />(ARR) for the McClane Canyon Mine. The ARR was received on January 24, 2008. The <br />Annual Reclamation Report was submitted in a timely manner and included the required <br />standardized reporting form and a detailed reclamation map. There were no acres backfilled and <br />graded, topsoiled, or seeded during the calendar year. <br />During our review we noted a difference between our Permit System disturbed acres and the <br />"actual" disturbed acres listed on the reporting form submitted by CAM. Our system currently <br />shows 11.2 acres of disturbance. CAM is reporting a cumulative total of 12.8 acres. There <br />appears to be two reasons for the discrepancy as follows. First with MR-37, which was the <br />revision for constructing a road up Munger Creek for the drill hole required by MSHA, the <br />operator estimated 1.6 acres of disturbance on the application form. But when the road and drill <br />pad were reclaimed, the actual disturbance was 3.3 acres. The "as-built" disturbance was 1.7 <br />acres greater than estimated when the revision was submitted. The operator has been reporting <br />the additional disturbance in the ARRs since 2005. Secondly with MR-44, which was the <br />revision for expanding the sediment drying area, the operator estimated 0.1 acre of additional <br />disturbance. This additional disturbance occurred in 2007 but was not accounted for and <br />reported on the standardized form submitted with the 2007 ARR. The Division has the following <br />comments to rectify the discrepancies. <br />1. Please submit an "as-built" disturbance shown on appropriate permit document map(s) <br />for the drill road and pad constructed with MR-37 and update the disturbed acreages (1.7 <br />acres) accordingly through a minor revision. <br />2. Please ensure that the 0.1 acre disturbance associated with MR-44 is accounted for on all <br />appropriate permit document map(s).
