DATE: July 21, 2008 <br />TO: Travis Marshall <br />FROM: Kate Pickford <br />RE: Third Hydrology Review of Lyster Oil Company, Inc., Lyster Pit, File No. M- <br />2008-009 Moffat County <br />The Division has reviewed the responses to the third hydrologic adequacy comments for the <br />Lyster Oil Company, Inc. 112c permit application for the Lyster Pit, File #M-2008-009, and <br />submits the following comments. <br />The Division agrees with the monitoring plan and mitigation plan submitted, but believes that the <br />following information should be included in the mitigation plan: <br />The Operator should also agree that mitigation measures will commence, even if the trigger <br />point(s) have not been reached, if a well user complains of lack of water in the well or if the <br />adjacent irrigated pastures begin to show signs of stress. In the case of the well user, the operator <br />should continue mitigation measures until the issue is resolved or in the event that it is determined <br />that the operation is not the cause of the decreased well production.
