If the pit is being actively dewatered, and the water levels in all the <br />monitoring wells drop at least eight (8) feet below the seasonally low water level <br />elevations observed during the baseline monitoring period, the pit operator shall <br />institute measures to either determine if the domestic wells are being negatively <br />impacted, or if mitigation is necessary. If the wells are losing production to the extent <br />that in-house domestic use demand of up to 350 gpd cannot be met due to a verified <br />lowered water table at the location of the domestic well, the pit operator shall <br />recharge the groundwater table within 200 feet of the perimeter of the pit through <br />supplemental irrigation or injection wells of clean discharge water from the pit <br />dewatering to the extent that dewatering water is physically available for recharge of <br />the aquifer. <br />b. Irrigation of adjacent fields. If during the irrigation season, the pit is being actively <br />dewatered, and the water levels in all the monitoring wells drop at least six (6) feet <br />below seasonally high water elevations observed during the baseline monitoring <br />period, the pit operator shall offer supplemental irrigation water to the adjacent land <br />owner. The most practical means of providing irrigation water will be to pump <br />dewatering water to areas in need of irrigation water. Supplemental irrigation shall be <br />offered to the extent that dewatering water is available, and irrigation water is needed. <br />If dewatering continues during winter months or non-irrigation months, the dewatering <br />discharge shall be discharged to the receiving drainage ditch, rather than discharged <br />onto adjacent fields. <br />3. The above plan is premised on the expectation that groundwater levels in the pit area <br />seasonally fluctuate from four (4) to eight (8) feet. Actual site conditions may vary some from <br />this assumption. Trigger and action points may need to be adjusted by the Division and the <br />Operator based on actual drawdown, or lack thereof. <br />4. Additionally, per discussions with yourselves July 22, 2008, the Operator agrees to <br />implement mitigation measures as described above even if the trigger points have not been <br />reached if a well user complains of lack of water in their well, or if the adjacent irrigated <br />pastures begin to show signs of stress, and is in need of irrigation. <br />Mitigation measures will continue until the issue or complaint is resolved, or until it is <br />determined that the operation is not the cause of decreased well production. Reasonable <br />access to the affected well(s) or irrigated pasture shall be provided to the Operator or his <br />designee to adequately assess and address complaints. <br />Ww'?a Ft87GOUrtcB CoHSUL'dM'6, LLC
