ORIGINAL - PUBLIC FILE <br />I <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: m 1999-nn4 <br />I <br />INSPECTION DATE: 6.49-408 INSPECTOR?S INITIALS: -BK- <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site to evaluate the adequacy of the <br />financial warranty after the applicant succeeded the operation from Continental Materials <br />to Tezak Heavy Equipment. <br />1) The site is a 112 quartzite quarry located approximately 15 miles North West of <br />Penrose Colorado. <br />2) The total permit area is 561 acres, consisting of 302 acres State LAND AND 259.40 <br />ACRES OF Federal land. The maximum affected acres for the site!as approved in <br />amended in 2003 is 45.5 acres. The maximum High wall length inllineal feet can not <br />exceed 2000 feet. It is very important for the operator to review the <br />amendment application that was approved in 2003, that increased the <br />permit area by 72.6 acres. That amendment clearly details the mining <br />and reclamation plan. <br />3) Present during the site visit was Mr. Rick Bohnenkamp of Tezak Heavy Equipment. <br />4) The entire affected area was inspected, site was active at the time of the <br />inspection. The area to be affected is divided in three Phases1 "A", "B" AND "C". <br />Mining can not commence in area "C", until it is completed in area "B". <br />5) According to the annual report a total of 28 acres are affected.6.5 acres in the <br />State land and 1.5 acres in the Federal land for mining purposes. The rest of the <br />affected acres are ancillary disturbance associated with the mining operation. <br />6) Even though the annual report mentioned areas reclaimed, DRMS,Iwas unable to locate <br />the areas reclaimed. <br />7) According to the current operator, once the current affect dares of active mining <br />left over by the previous operator are all cleaned up they plan to undertake <br />reclamation activates and hope to reclaim most of the current affected area. <br />8) At present the financial warranty of $202,793, only covers areas ""All and '"'B". <br />Operator must contact the Division and obtain written approval prior <br />to conducting any activity in area "C". Again the Division suggests <br />the operator review the amendment application that was approved in <br />2003, to make sure areas not approved to be affected1with out an <br />approval are not affected. <br />9) At present the warranty is adequate to cover the cost of reclamation. <br />However, the Division request the operator to conduct a detailed <br />survey of the affected areas and provide a map showing the current <br />disturbance in the 20'08 report.
