MEMO <br />To: CV-2008-002 file <br />From: Tom Kaldenbach 1t< <br />Date: July 21, 2008 <br />Re: Basis for Issuing Notice of Violation CV-2008-002 <br />During my inspection of the King Coal Mine on June 17, 2008 I asked the operator's <br />representative to point out on the mine's map the location of current room-and-pillar <br />mining. The representative pointed out on a map the location of active mining in Section <br />6 of TI IN, R34W. The map I was shown indicated a new submain had been constructed <br />that was not depicted on the approved mine plan map in the permit application, Map King <br />I-005. Also, some of the workings on the approved mine plan map were not shown on <br />the map at the mine. Comparison of the map I was shown at the mine (showing the <br />actual workings) with the approved Map King I-005 indicates the approximate 7 acres of <br />new submain is similar in the amount of area to the workings removed from the map <br />showing actual mining (see attached sketch maps). On June 23, 2008, the operator <br />submitted Technical Revision 14 consisting of an updated mine plan map. Notice of <br />Violation CV-2008-002 was issued on July 3, 2008. DRMS issued a proposed decision <br />to approve TR-14 on July 21, 2008.
