It addresses questions and concerns raised in the April 17, <br />2008 Adequacy Review, the June 3, 2008 Second Adequacy Review, and discusses potential <br />impact to water wells, surface water diversions, and the Deep Cut Ditch. <br />In summary, it is our opinion that the pit as proposed is highly unlikely to have a material <br />impact on existing water rights or wells or irrigation ditches in the general vicinity of the <br />proposed pit. <br />The format of this letter follows the comments in the Adequacy Review letters. The entirety of <br />the review comments is not repeated here, but are summarized as bullet points. <br />Adequacy Review Letter of April 17, 2008 <br />1) Rule 6.4.7(1) requires the operator to directly state if surface water or groundwater will be <br />affected by the mining operation. <br />Surface Water- Direct Diversions <br />A review of existing surface water rights within approximately one-quarter to one-half mile <br />of the proposed mine shows that there are four nearby surface water rights.
