October Ore Pile Reclamation Rule 8: ERP <br />110(d) Limited Impact Permit Application <br />Nuvemco LLC October Ore Pile Reclamation <br />6.4.20 Exhibit T - Designated Mining Operation Environmental <br />Protection Plan <br />6.4.20 (1) Environmental Protection Plan <br />The October Ore Pile Reclamation Limited Impact 110(d) Designated Mining <br />Operation consists of removing an existing low grade uranium and vanadium ore pile <br />from a claim in a historic uranium mining district. The ore will be removed and the site <br />will continue to be utilized for livestock grazing and wildlife habitat use. Pursuant to <br />recent legislation, this uranium-bearing ore is considered to be a toxic or acid-forming <br />material when exposed or disturbed resulting in this reclamation operation being <br />considered a designated mining operation. No chemicals will be used, stored, handled, <br />exposed, disturbed or disposed of within the permit area. The ore is indigenous to the <br />Uravan Mineral Belt, common in old mine dumps and in select outcrops of the host <br />sandstones in the area. <br />6.4.20 (1) (a-d) <br />NA. These rules addressed in following <br />6.4.20 (1) (e) The Board shall also consider current conditions and the degree to <br />which the proposed plan would provide for net improvements in the protection of <br />human health, property or the environment. <br />Nuvemco, LLC respectfully requests that the Board recognize that removal of this <br />ore pile from its current location will be a net improvement to the area of the site. This <br />improvement will be as a result of removing potentially toxic or acid-forming materials <br />and to improved wildlife habitat with the placement of soil and re-vegetation of a barren <br />location. <br />6.4.20 (2) Maps <br />The previously described and enclosed maps in previous exhibits showing the <br />location of the low grade ore pile and the route by which the ore will be trucked out of the <br />area on existing mining roads, maintained county roads and state highways. <br />6.4.20 (3) Other Environmental Protection Requirements <br />No additional permits for other agencies are required beyond those specified in <br />6.3.6 - Exhibit F. The US Nuclear Regulatory Commission recognizes shipping of <br />uranium ore as a "Low Specific Activity", that the "material may be shipped in bulk and <br />presents a minimal health hazard in transport." Operator Nuvemco and trucking <br />contractors will use Best Management Practices and are familiar with the US <br />Department of Transportation "2008 Emergency Response Guidebook" in the event of <br />ore truck accidents. <br />6.4.20 (4) Other Permits and Licenses <br />NA. No chemicals will be used within the permit area. <br />6.4.20 (5) Designated Chemical(s) Evaluation <br />NA. No chemicals will be used within the permit area. <br />48
