12. Based upon the possible potential for ground water impacts from dewatering and lining the pit, monitoring <br />wells should be considered and installed to ensure compliance with Rule 3.1.6(1) of the Construction Material <br />Rules and Regulations which require that "disturbance to the prevailing hydrologic balance of the affected <br />land and to the surrounding area and to the quantity and quality of water in surface and ground water systems <br />both during and after the mining operation and during reclamation shall be minimized..." In particular, the <br />Division recommends monitori ng wells be selected or installed to monitor impacts that may affect registered <br />and unregistered wells and vegetation on both sides of the river. <br />13. Please identify all cottonwood groves in the wildlife corridor and within the boundaries of potential offsite <br />ground water impacts to help assure adequate monitoring is in place. <br />14. The applicant states that registered alluvial wells within 600 feet were identified based on SEO records. Were <br />field inspections conducted to identify ALL wells within 600 feet? Please revise the exhibits to depict the <br />actual location of the alluvial wells. Will any wells beyond the 600-foot radius be affected by the mining <br />operations? <br />15. Please depict the location on a map where mine water will be discharged. If mine water is discharged into a <br />ditch or other man-made structure, please provide consent to discharge water into this structure. If water is <br />discharged into a ditch that is unlined, it may be prone to erosion if the discharge rates exceed the carrying <br />capacity of the ditch. The applicant should submit documentation to the Division for review as to the <br />proposed maximum discharge rate into the ditch and specifications as to how much water the ditch can cant' <br />without experiencing erosion. <br />Rule 6.4.14 Exhibit N- Source of Legal Right to Enter <br />16. The applicant submitted a letter from the Division of Wildlife (DOW) regarding an easement on the property <br />located on the southwest corner of Colorado Highway 392 and Weld County Road 13. Please depict this area <br />on the map, and describe what measures are to be taken to protect the DOW's interest on the property. <br />Rule 6.4.19 Exhibit S- Permanent Man-Made Structures <br />17. The applicant proposes to mine through a number of structures (i.e. power poles, culverts wells and the <br />concrete lined ditch). If Connell Resources intends to mine through existing structures then they will need to <br />submit a notarized agreement between the operator and the owner(s)/easement holders of the structures. Until <br />such agreement is/are submitted and approved by the Division, the applicant will need to maintain a suitable <br />mining off- set distance from the structures. If such notarized agreements cannot be achieved during this <br />review period, then a revision to the permit will need to be filed in the future prior to mining closer than the <br />approved mining off-set distance. <br />18. Exhibit S contains a list of man made structures on or within 200 feet of the permit area. The applicant will <br />need to state the name and address of who owns the structure and the proposed mining off set distance from <br />each structure (i.e. SH 392, CR 13, utilities, etc...). <br />The Division received objections to the SerFer Pit 112c Application from Jonathan and. Jessica Lee and the <br />Colorado Department of Transportation (CDOT). See attached letters. Please address the comments noted in the <br />letters. Because objections have been filed, the item will automatically be extended on or before the 1200, day and <br />will be scheduled before the Mined Land Reclamation Board (MLRB) during the June 11-12, 2008 MLRB <br />hearing. However, the Division must make a recommendation to approve or deny the application to the MLRB <br />on May 20, 2008. <br />Please be advised that the SerFer Pit New 112 Application may be deemed inadequate, and the application may be <br />denied on May 20, 2008 unless the above-mentioned adequacy review items are addressed to the satisfaction of
