Cattany <br />DATE: July 15, 2008 Division Director <br />y Natural Resource Trustee <br />RE: NOV CV-2008-001 <br />Recommendation to Extend Abatement Deadline Beyond 90 Days <br />Seneca Coal Company has requested an extension for Abatement Step 2 of NOV CV- <br />2008-001. The NOV was issued May 2, 2008 at the Yoast Mine and the current <br />abatement deadline is set at July 31, 2008, 90 days beyond the NOV issuance. This is the <br />maximum number of days allowed for abatement without the Director's approval. Due to <br />climatic conditions, as discussed in their attached letter, Seneca is unable to satisfactorily <br />abate Step 2 of the NOV by July 31, 2008. Rule 5.03.2(2)(c) allows the abatement <br />deadline to be extended beyond 90 days for specific listed reasons with the Director's <br />approval.
