The application proposes to conduct coal mining <br />operations in Colorado. The proposed operation will mine and ship up to eight million <br />clean tons of coal per year. <br />According to information provided in the Preliminary Draft Environmental Impact <br />Statement, dated March 20, 2008, and a response letter, dated June 5, 2008, from Gary <br />Isaac to Michael Boulay, mine water discharge remains an issue. Specifically, the <br />location and amount of the mine water discharge should be identified and quantified. <br />The DRMS and the applicant should be aware that the area is over-appropriated, as <br />such, any diversions could potentially result in depletions that impact downstream or <br />senior water right uses. Therefore, the applicant would be required to replace any <br />depletions pursuant to an approved substitute water supply plan or plan for <br />augmentation.
