• OTHER PERMITS AND LICENSES REQUIRED EXHIBIT M <br />The following additional permits and environmental plans are needed for the site: <br />1) Plan of Operations and Environmental Assessment -Finding of No Significant Impact by the <br />BLM. This approval process will include clearances for cultural resources and threatened, endangered, <br />and sensitive species. <br />2) County Conditional Use Permit - issued by Mesa County. The permit will also include a road <br />access permit. <br />3) Colorado Discharge Permit System process water and storm water discharge permits -issued <br />by the Water Quality Control Division of CDPHE (see Appendix L). A stormwater management plan <br />and material containment plan (see Appendix F) will be prepared in conjunction with these permits. <br />• 4) Air Pollution Emission Notice for Fugitive Dust -construction permit issued by Air Pollution <br />Control Division of CDPHE. <br />5) Mine Permit -issued by the Mine Safety and Health Administration (MSHA). <br />6) A Spill Prevention, Control and Countermeasure (SPCC) Plan will be prepared in accordance <br />with 40 CFR, Part 112 of federal regulations for storage of fuel and oil on site (See Appendix F). <br />7) Water Right and Well Permit for mine dewatering and water use -issued by the Water Court <br />for Water Division 4 (Montrose) and the State Engineer's Office, respectively. <br />8) Individual Sewage Disposal System and Building Permits -issued by Mesa County. <br />Note: Surface disturbance will not impact any wetlands or drainages; therefore, permits with the U.S. <br />Army Corps of Engineers are not required. <br />• <br />Whirlwind Mine 07 (rev.
