' 110 Permit Application Colorado Division of Reclamation, Mining and Safety <br />' LEGAL DESCRIPTION AND LOCATION MAPS - EXHIBIT A <br />' BDM has prepared responses to each of the review standards in Section 6.3.1 in the <br />Construction Material Rules and Regulations. The review standard is stated followed by BDM's <br />response. <br />(1) Rule: The legal description must identify the affected land, specify affected areas and be <br />1 adequate to field locate the property. Description shall be by (A) and (B). <br />(A) Rule: township, range, and section, to at least the nearest quarter-quarter section. <br />Response: The affected land from the proposed shale borrow pit is located in the <br />Southeast Quarter of the Southwest Quarter of Section 25, Township 7 South, Range 94 <br />West of the 6th Principal Meridian. The affected land (site or permit area) occupies <br />1 approximately 1.50 acres with surface and mineral rights wholly owned by Black <br />Diamond Minerals, LLC. The site is part of a larger private land holding called the Tepee <br />Park Ranch. The Tepee Park Ranch occupies approximately 4,332 acres within Garfield <br />County, Colorado. The ranch is mostly surrounded by U.S. Forest Service (USFS) <br />administered lands with a small portion of the northern property boundary adjoining U.S. <br />Bureau of Land Management (BLM) administered lands. <br />(B) Rule: location of the main entrance to the mine site reported as latitude and longitude, or <br />the Universal Transverse Mercator (UTM) Grid as determined from a USGS topographic <br />' map. A metes and bounds survey description is acceptable in lieu of Township, Range, <br />and Section. Where available, the street address or lot number(s) shall be given. This <br />information may be available from the County Assessor's office or U.S. Geological <br />Survey (USGS) maps. <br />' Response: The main entrance to the mine is located at Latitude 39 degrees, 24 minutes <br />, <br />15.85 seconds; Longitude 107 degrees, 50 minutes, 11.17 seconds. <br />' (2) Rule: The main entrance to the mine site shall be located based on a USGS Topographic <br />map showing latitude and longitude or Universal Transverse Mercator (UTM). The operator <br />' will need to specify coordinates of latitude and longitude in degrees, minutes and seconds or <br />in decimal degrees to an accuracy of at least five (5) decimal places (e.g., latitude 37.12345 <br />N, longitude 104.45678 W). For UTM, the operator will need to specify North American <br />' Datum (NAD) 1927, NAD 1983, or WGS 84, and the applicable zone, measured in meters. <br />Response: USGS topographic map based latitude and longitude is present above in section <br />(1)(B). <br />(3) Rule: A map showing information sufficient to determine the location of the affected land on <br />the ground and existing and proposed roads or access routes to be used in connection with <br />the mining operation. Names of all immediately adjacent surface owners of record shall also <br />be shown. The operation location map shall be a standard 1:24,000 scale U.S. Geological <br />Survey map. The location of the proposed operation shall be shown and labeled with the <br />mine site name. <br />Response: Figures 1, 2, and 3 in this exhibit present two aerial photos of the site and a <br />USGS topographic quadrangle map-based figure, respectively.
