5TATE OF COLORADO
DIVISION OF MINERALS AND GEOLOGY
Department of Natural Resources
1313 Sherman St., Room 215
Denver,Colorado 80203
Phone:(303)866-3567
FAX:(303)832-8106
DEPARTMENT OF
January 17 , 1995 NATURAL
RESOURCES
Mr. W.D. Corley, Jr.
The Corley Company Roy Romer
Governor
P.O. Box 1821
Colorado Springs, Colorado 80901 ExecuS.Lochhead
Executive Director
Michael B.Long
RE: GEC East Pit Project Division Director
Dear Mr. Corley:
Thank you for your letter of December 31, 1994 . As you may be
aware, the State and the Contractor are currently in a claims
dispute. The Contractor is currently in the process of appealing
his construction claims to the Executive Director and is requesting
an amount of money greater than the bond amount. We cannot predict
the outcome and it would be inappropriate for me to speculate on
how much bond money remains while this claim is being considered by
the Executive Director.
During construction, the Project Manager measured the project
slopes with an abney level. On December 15, 1994 the Division
surveyed the project site using a Zeiss-Elta 3 survey instrument.
No major slope areas were steeper than 3 : 1 (Horizontal:Vertical) .
Sincerely,
/ James B. McArdle
Senior Environmental Protection Specialist
