You are correct in <br /> stating that the contract for the East Pit work specified that the <br /> slopes would be graded to 3 : 1 Horizontal to Vertical. Based upon <br /> post-construction observations and measurements, the Division <br /> believes that all slopes have been graded to 3 : 1 (H:V) or less <br /> including the westerly slope of Chennts Hill and the northerly slope <br /> of the hill between the East and West Pits. The Division <br /> recognizes that, within the Project area, there are minor areas <br /> where the slopes exceed 3 : 1 (H:V) such as portions of the road <br /> shoulders and ditches. The Division believes this variance to be <br /> minor and problems which may result will be corrected subject to <br /> available funds. <br /> Again, thank you for bringing your concerns to my attention. <br /> Sincerely, <br /> James B.
