6
he and I as a point of conflict with others who were
not involved, but he insisted that the Division as a
whole, and unfortunately I was a part of it, had
pushed him too far, and felt it was necessary to use
the incident as part of"his hand", in the forth coming
law suit. At this point I asked him if he objected to
the backfilling of the vents and holes, and he said no,
that it needed to be done. I asked him if he
understood my motives in using the materials from a
disturbed area adjacent to the job site, and which is to
be reclaimed soon, and he said yes, that it was a
logical approach, but I should have checked with him
first. I told
him we were having a problem with Dr. Corley, and
that he should stop work on the project. I inquired as
to the details of the agreement Corley had made
regarding use of the fill. Bill re-affirmed that Dr.
Corley had given him permission to use the fill
materials at 25 dollars per load, and that he had
maintained a load count. I instructed Bill to go ahead
and pay for what they had used, and that I would
prepare a change order to cover the un-anticipated
cost of the backfill materials upon receipt of a copy
of his check and cover letter. I asked about the gate,
and Bill said they accidently scratched and dented it
with the truck, but that they had since repaired it, and
that it was fine.
10:15 am- I informed Jim McArdle of the above events and Dr.
