SerFer Pit 112 Reclamation Permit Application M2008006

The following discussion and attachments are submitted on behalf of our client, Connell
Resources, Inc., in response to your letter dated May 2, 2008 in reference to "SerFer Pit 112
Reclamation Permit Application M2008006." The information and discussion below address
each comment within the formal objection to the Permit Application as it was presented:
1. The flood waters of the Poudre River have encroached upon our property during the flood
of May 1999. Since this time the Hall Irwin mine to the Northeast of the subdivision has
increased the land.elevation for dredging operations of the Windsor Lake.
a. We would like for the Division to guarantee flood waters will not affect the homes in
the River West subdivision while the SerFer Mine is in operation;
It is our belief that the proposed mining operation and subsequent reclamation
will not increase the flood levels on the site. A floodplain study has been
completed. Results of the floodplain study have been included in the DRMS and
Town of Windsor permit applications. The floodplain study shows no adverse
impact to the floodplain will be caused during or after mining. Connell
Resources, Inc. will not begin mining activities until all applicable permits are
approved. This includes obtaining and adhering to a development permit as
required by the Town of Windsor Municipal Code (Title IX Flood Damage; Flood
Control; Drainage).
b. We would request all FEMA and Corps of Engineering analysis and permits be
provided to us. We have already had home owners insurance companies inquire about
the flood insurance requirements; and
All records of public interest which cannot be withheld as confidential will be
made available to the public. The project is not changing the flood maps;
therefore the flood rating of your home will not be altered.
