STATE OF COLORADO <br />TO: <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: Marathon Oil Company ) NOTICE OF VIOLATION MV-2008-008 <br />743 Horizon Ct Ste 220 ) AND <br />Grand Junction, CO 81501 ) CEASE AND DESIST ORDER <br />Marathon Oil Company and all other persons engaged in or owning or controlling the following operation: Circle <br />Dot Quarry, M-2007-067. <br />FINDINGS OF FACT <br />2 <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by C.R.S. 34-32.5-124, <br />the Board hereby makes the following findings of fact: <br />Marathon Oil Company is permitted to conduct a construction material extraction mining operation under the <br />terms of Permit M-2007-067 located in Section 1, Township 6S, Range 97W, 06th Prime Meridian, in Garfield <br />County, Colorado. <br />The Mined Land Reclamation Board conducted a Formal Public Hearing on July 9, 2008 to consider possible <br />violation of the terms of Permit M-2007-067 and C.R.S. 34-32.5-101 et sec. <br />The Division of Reclamation, Mining and Safety presented evidence at the Formal Public Hearing on July 9, 2008, <br />demonstrating that: <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with C.R.S. 34-32.5-124(6), the Colorado Mined Land <br />Reclamation Board hereby finds Marathon Oil Company to be in violation of Permit M-2007-067, C.R.S. 34-32.5-
