Andrew Newhart -2- July 8 2008 <br />Release Water <br />Regardless of the classification of the water, Bear hereby requests release of the <br />seepage water from the permit based on its "good" quality rather than its <br />classification as a spring. <br />Reduce Monitoring Parameters and Frequency <br />Bear hereby requests relief from future WET testing. The mine seepage water is <br />non-toxic as explained above. There is no industrial activity on site that would <br />cause the water to become toxic. Bear also requests the schedule for collection <br />of field parameters (flow, pH, oil and grease) be reduced to monthly. This <br />request is made to avoid unproductive use of Bear's limited resources. <br />Water Direct to River <br />Bear hereby requests that the seepage water be allowed to bypass the treatment <br />pond and be discharged directly to the river. As can be seen from the attached <br />table, the treatment pond does not improve the quality of the seepage water. <br />Enclosed is an amended Site Sketch that shows the seepage water piped <br />directly to the river. <br />Sincerely, <br />/I 06??_ <br />J.
