Sherman <br />Executive Director <br />Dick Wolfe, P.E. <br />Director <br />RECEIVED <br />JUL 0 7 2008 <br />Division of Reclamation, <br />Mining and Safety <br />This letter is in response to your application of May 6, 2008 on behalf of Connell Resources, Inc. <br />(Applicant) requesting a substitute water supply plan (SWSP or plan) for a sand and gravel pit owned and <br />operated by Applicant in accordance with Section 37-90-137(11), C.R.S. The Applicant shall be <br />responsible for compliance with this plan. The required fee of $1,593 for the substitute water supply plan <br />has been paid. <br />Plan Operations <br />This plan seeks to replace depletions resulting from the mining at the SerFer Pit ("Gravel Pit"). <br />The depletions that result from the proposed dry-mining operation include evaporation, dust control, and <br />water lost in mined product during the first two years of this new mining operation. The Applicant <br />proposes to construct dewatering trenches to allow for dry-mining and to reduce the evaporative losses <br />associated with the operation. The applicant is currently seeking a bond to cover the permanent filling of <br />the pit should the operator walk away during the dewatering process thus leaving a large exposure of <br />ground water and associated evaporation liability. No ground water shall be exposed on the subject <br />property until such time as the Applicant provides proof to this office and the water <br />commissioner that such a bond is in place. Mining of the SerFer Pit will last for approximately 4 <br />years. Once reclamation is complete, a lined reservoir will be created and will have a total surface area <br />of approximately 20 acres. The proposed replacement source is excess credits from a recharge project <br />involving 2.0 shares of the Box Elder Ditch as previously approved for replacement use in conjunction <br />with the Applicant's Stute Pit (M-81-007) and Timnath-Connell Pit (M-99-050). <br />Depletions <br />This plan describes the proposed water uses from August 1, 2008 through July 31, 2010 for this <br />proposed new pit. The proposed plan anticipates a maximum year depletion of 9.2 acre-feet from an <br />exposed ground water surface area of 0.49 acres consisting of 0.09 acres in two settling ponds and <br />approximately 0.4 acres in the dewatering trenches.
