M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was an aerial inspection of the McClane Canyon Mine conducted by Harry Ranney of the <br /> Division of Reclamation,Mining and Safety(DRMS). Aerial photographs were taken on June <br /> 10, 2008 at approximately 1:42 p.m. Weather conditions appeared to be clear and sunny at the <br /> time of the flight. Mike Boulay of the DRMS reviewed the aerial photographs. <br /> Six photographs were taken during the flyover. The majority of the mine site was visible in the <br /> photographs including all mine facilities from the portal area down to the office location, and <br /> including the sediment pond and the expanded coal waste temporary storage area. <br /> There is not a lot of site activity discernible in the photographs. A loader was active at the coal <br /> stockpile but there were no haul trucks visible. Several vehicles were parked at the mine office. <br /> No other site activity was apparent in the photographs and no problems were noted in any of the <br /> aerial photographs. <br /> Roads <br /> The mine site roads visible in the photographs were dry, and appeared well maintained and in <br /> good condition. <br /> Hydrologic Balance <br /> The mine site was mostly dry. From the photos it appears that MCM is still in the process of <br /> cleaning out the sediment pond. <br /> Processing LWas <br /> te <br /> The temporary coal waste pile area is clearly visible in the photographs. This location including <br /> the access road,clean water diversion and the berm around the waste pile are stable and are in <br /> good condition. <br /> General Mine Compliance <br /> The facilities areas are well maintained. All site locations appeared stable and no significant <br /> erosion or other problems were identified with this aerial inspection. <br /> II <br />
