Ill. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the New Horizon Mine conducted by Marcia Talvitie of the <br /> Colorado DRMS. Ross Gubka and Dave Anderson represented the operator, Western Fuels - <br /> Colorado (WFC), and were present throughout the entire inspection. The weather was clear, <br /> hot and dry. <br /> Roads <br /> County Roads BB and 2700, reconstructed by WFC, have now been opened to the traveling <br /> public. <br /> Hydrologic Balance <br /> Mine dewatering was no longer being directed to Pond 007. Rather, with the approval of TR-56 <br /> in May 2008, the water is pumped to an elevated tank (Figure 1) for use in dust control. Any <br /> overflow from the tank flows to Pond 011. Pond 011 did contain water (Figure 2) and was <br /> discharging at a slow rate. A Parshall flume was installed as required between the pond's outlet <br /> and Tuttle Draw (Figure 3). <br /> Pond 012 still retained some water, although the elevation has continued to drop as <br /> evaporation has occurred. <br /> Backfill & Grading <br /> Subsoil was being excavated from the mine area by shovel, and being loaded into haul trucks <br /> for transfer to the fill area east of the pit (Figure 4). <br /> General Mine Plan Compliance <br /> The mine appears to be operating in accordance with Section 2.05 of the approved Permit. <br /> Fish & Wildlife <br /> Ross Gubka pointed out a killdeer nest which held four eggs, located on the northern bank of <br /> Pond 011 (Figure 5). WFC was taking care not to disturb the nest. <br /> Air Resource Protection <br /> Haul roads within the permit area were dry, and the haul trucks generated fugitive dust as they <br /> traveled from the mining area to the dump site. With the dry weather conditions, WFC must <br /> continue to ensure that the requirements of the mine's air quality permits are met. <br /> Reclamation Success <br /> Ward Burbridge owns a parcel of land (Figure 6) that has been included in the Phase II bond <br /> release portion of WFC's application for SL-1 1. In response to a request from Mr. Burbridge, the <br /> three of us visited his property and were shown several locations of the reclaimed irrigated <br /> pasture with which he is not satisfied. <br /> New Horizon Mine C-1981-008 19-Jun-2008 <br />
