Box 53 Natural Resource Trustee <br />Saguache, Colorado 81149 <br />? ?/ ? <br />Re: Breeze Basin Sand and Gravel Pit, 112c permit Application No. M-2008-022, DBMS Hydrology <br />Engineering Review and Correspondence Forward. <br />Dear Mr. Scanlon, <br />The Division of Reclamation Mining and Safety has received a memo from staff engineer Allen <br />Sorenson regarding the hydrological engineering review of the above referenced application. Please <br />review the memo and respond back to the Division regarding the issues of concern noted. The primary <br />issue is mitigation of impacts within the 100 year flood plain. <br />DRMS has also received additional correspondence from the Deep Cut Irrigation Ditch, Inc. It is noted <br />that Deep Cut may wish to resolve their issues without going to a formal hearing. Staff strongly <br />encourages both sides to make every attempt to resolve outstanding issues and avoid unnecessary <br />expenditure of time and resources if at all possible. <br />Staff review of TMS response to the Preliminary Adequacy Review notes the following: <br />1) The operator will need to commit to permanently marking any delineated wetlands to prevent <br />disturbance in these areas. <br />2) The final configuration has been changed to a single lake as opposed to two. This is in <br />response to wetlands and other issues that make a single lake more appealing for the <br />production of materials. <br />3) Although COE has made no comments regarding river capture, DRMS has a responsibility to <br />ensure that such events are mitigated by the best practices possible. Those issues are part of <br />Mr. Sorenson's review which is attached. <br />4) Kate Pickford, staff's hydrological review person, will review the responses addressing her <br />memo. If there are any further issues or ones not yet fully addressed staff will forward her <br />additional comments on when received. <br />5) Please note that comments concerning hours of operation, work force, county hearing <br />processes etc are outside the jurisdiction of this office.
