I feel that it is pertinent for you to receive a copy <br />of the cover letter of this Promise to Correct. It was signed as acknowledgement of <br />receipt of the document. We feel that this agreement does not override the need for any <br />kind of testing. <br />On May 6, 2008 the Ditch Company invited the owners to meet with the share holders on <br />May 22°d to discuss ways to protect the intake channel, ditch and its structures in the <br />vicinity of the planned gravel pit: The Gravel Permit for Moffat County was predicated <br />on an agreement between the owners and the Ditch Company. The owners did not attend <br />the meeting on May 22"d, but Lisa Lawton, manager of Elam Construction in Craig <br />attended the meeting and discussed solutions, and intended to take the suggestions back <br />to the owners. Lisa Lawton's employment has now been terminated from Elam <br />Construction, so the discussions of solutions May 22nd are now out of the equation. We <br />have asked Tim Scanlon twice to ask the owners to meet with us to discuss an agreement, <br />but so far they have refused.
