III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Hamilton Mine conducted by Marcia Talvitie of the <br /> Colorado DRMS. Dave Andrews, the landowner, was present during the records check. No one <br /> represented the operator during the field inspection. <br /> Availability of Records <br /> Records were available for viewing at the nearby Landfill office. A completed DRMS Availability <br /> of Records checklist is attached. <br /> Signs and Markers <br /> A Mine Identification Sign was posted at the entrance to the mine permit area. Additional signs <br /> were posted throughout the area, as required. <br /> Roads <br /> Roads were dry, and all areas of the permit were accessible by vehicle. <br /> Hydrologic Balance <br /> Pond A was completely dry. The water level in Pond B was considerably lower than what was <br /> observed during the May 2008 inspection (Figure 1). According to Mr. Andrews, he had opened <br /> the valve at the engineer's direction, and drawn down the level of the pond. A sample of the <br /> discharge was collected and submitted for analysis. There was no standing water at the <br /> downstream end of the discharge pipe. <br /> At the roddway turnoff to Mine 3, the two 18" culverts were inspected and found to be clear. A <br /> large tree lay across the channel immediately downstream of the lowermost culvert (Figure 2). It <br /> did not' appear that the tree had obstructed flow in the channel, but the potential may exist. <br /> Conversely, the tree might serve to slow the velocity in the channel and inhibit downstream <br /> erosion. The culvert crossing the road to Mine 3 (north of the stock pond) was also clear. <br /> Topsoil <br /> Topsoil piles throughout the permit area were fenced to prevent access by cattle, and were <br /> clearly identified with signs. The vegetative cover on the piles south of Mine 3 was mainly cheat <br /> grass. <br /> Revegetation <br /> Beneficial species observed included Indian rice grass, rubber rabbit brush, sage, four-wing salt <br /> bush, scarlet globemallow. For unknown reasons, several rabbit brush bushes located at the <br /> turnoff to Mine 3 exhibited yellow foliage. Yellow sweet clover was common throughout. <br /> Weeds <br /> Two small patches of Knapweed were observed: one located immediately southwest of Pond A, <br /> near the fence corner, and another at the east end of the dam for Pond B. In the immediate <br /> vicinity of the Pond B knapweed, a small patch of Whitetop was also observed. The vegetation <br /> at the east end of the dam did not include the desirable species located immediately to the <br /> west. Perhaps the surface had been disturbed at some time following reclamation, but was not <br /> re-seeded with the approved seed mix. <br /> Hamilton Mine C-1991-078 19-Jun-2008 <br />
