III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Tom Kaldenbach of the Colorado Division of Reclamation, <br /> Mining and Safety. Jim Jarvis represented the operator. With the operator's consent,this report was issued <br /> from the Denver office of DRMS. <br /> The operator's representative reported that the King I Mine was actively mining in Section 6 and the <br /> King II Mine was mining approximately 1,400 several hundred feet in from the portals. The weather <br /> was clear and the ground was dry. <br /> Availability of Records <br /> The results of the records check are shown on the attached list. All required records were available, <br /> with the exception of the refuse pile and pond reports for the 4th calendar quarter 2007 (consultant Don <br /> May's report for 4th quarter 2007). These reports were mistakenly shown as available in previous <br /> DRMS inspection reports. The operator has a call in to Don May inquiring about the missing reports. <br /> Signs and Markers <br /> King I - Mine i.d. signs and affected area markers were properly displayed. <br /> King II—A mine i.d. sign was on display at the mine's entrance on County Road 120. The perimeter <br /> of the affected area was marked with"permit boundary" signs and survey stakes. <br /> Roads <br /> King I -The mine entrance haul road was well maintained. <br /> King II -The haul/access road was well maintained. A steel cattle crossing has been installed at the <br /> entrance. <br /> Hydrologic Balance <br /> King I Ponds - The east pond was dry and the west pond contained a small pool of water. Sediment <br /> has accumulated in both ponds since Fall 2007, but the sediment level is below the clean out level for <br /> both ponds. Embankments, inslopes, and spillways appeared in good condition. The operator's <br /> representative pointed located the outlet end of the secondary spillway (8"pipe) of the west pond <br /> where it is exposed at the base of the pond embankment. Both ponds had sediment level markers in <br /> place. <br /> King II Pond—The pond was dry. The dimensions of the pond and its spillway riser culverts were <br /> checked against the original design drawing that was approved in Permit Revision 8 (drawing King II- <br /> 007C). The pond was paced through the middle of the pond and found to be 420 feet long, by 58 feet <br /> wide. The inlet end of the 24-inch diameter principal spillway riser culvert was 8 feet above the <br /> bottom of the pond. The inlet end of the 24-inch diameter secondary spillway riser culvert was 9 feet <br />
