M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was an aerial inspection of the Roadside Portals Mine conducted by Harry Ranney of the <br /> Division of Reclamation, Mining and Safety(DRMS). Aerial photographs were taken on June <br /> 10, 2008 at approximately 11:10 a.m. Weather conditions appeared to be clear and sunny at the <br /> time of the flight. Mike Boulay of the DRMS reviewed the aerial photographs. <br /> Eighteen photographs were taken during the flyover. The majority of the mine site was visible <br /> in the photographs including the North Portal reclaimed area, the South Portal facilities, the UTL <br /> loop, and the CRDA waste disposal sites. The only activities visible in the photographs were <br /> Xcel Energy trucks hauling ash from the Cameo Steam Plant to the ash disposal site adjacent to <br /> the permit area. There was no activity at the UTL. There were a couple of vehicles parked near <br /> the Kokopelli retail fruit stand at the South Portals area. Facilities at this location were well <br /> maintained. No other site activity was apparent in the photographs and no problems were noted <br /> in any of the aerial photographs. <br /> Roads <br /> The mine site roads visible in the photographs were dry, and appeared well maintained and in <br /> good condition. <br /> Hydrologic Balance <br /> The mine site was mostly dry. There did appear to be some small areas of standing water in a <br /> few locations from recent precipitation that occurred last week. The Colorado River is running <br /> very high due to the substantial spring runoff this year. The UTL ponds 1 and 2 were the only <br /> sediment ponds retaining a visible amount of water in the photographs. <br /> General Mine Compliance <br /> All site locations appeared stable and no significant erosion or other problems were identified <br /> with this aerial inspection. <br /> 11 - <br />
