III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division). A final Phase III bond release application is <br /> pending for the majority of the reclaimed area at this site. Ground conditions were very dry <br /> and the weather was hot and windy. <br /> Availability of Records <br /> The public copy of the mine records is kept at the office of Peak Project Management (PPM). <br /> The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br /> Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. All records <br /> were found in compliance as detailed on page 2a of this report. <br /> Signs and Markers <br /> Disturbed boundary markers have been removed. Signs identifying the reclaimed area have <br /> also been removed. <br /> Hydrologic Balance <br /> A search for alluvial well ACAW- <br /> 1 in the mouth of Apache <br /> Canyon was unsuccessful. All <br /> indications are that this well was <br /> either previously abandoned or <br /> destroyed during pipeline <br /> construction related to coal bed <br /> methane development on the <br /> property. If not already done, <br /> please submit an abandonment <br /> report for this well using the <br /> best available information. <br /> Well LA-218 (right) remains un- <br /> reclaimed at this time. This site <br /> is actually two wells, one of <br /> which was sealed and an abandonment report received by the Division April 26, 2002. In a <br /> letter received by the Division on June 12, 2008, the operator has requested that LA-218, <br /> NM-20, NM-21, NM-22, NM-23, and SF-2 not be considered in the pending bond release <br /> application. The Division will therefore retain bond monies for reclamation of these wells. <br /> 3 <br />
