(Page 2) <br />MINE ID # OR PROSPECTING ID # M-2008-006 <br />INSPECTION DATE 05/29/08 <br />INSPECTOR'S INITIALS PSH <br />This was a second pre-operation inspection of the SerFer Pit conducted by Peter Hays with the <br />Colorado Division of Reclamation, Mining and Safety. John Warren with Connell Resources, <br />Inc. was present during the beginning of the inspection. <br />The site is located approximately 2 miles west of the town of Windsor on the southwest corner <br />of Highway 392 and County Road 13 in Larimer County, Colorado. The New 112c application was <br />received by the Division on February 7, 2008 and deemed complete for purposes of filing on <br />February 20, 2008. <br />The SerFer Pit adequacy review letter was sent to Connell Resources, Inc. on April 10, 2008 <br />by the Division. <br />The Division received several objections to the SerFer pit during and after the public <br />comment period. The original decision date for the SerFer Pit was May 20, 2008. The <br />Division received and approved a 60-day extension to the decision date by Applegate Group, <br />Inc. (Applegate)on May 7, 2008. The new decision date is July 21, 2008. <br />This inspection was in response to a comment made during a meeting with Applegate. During <br />the meeting, Ty Thompson with Applegate mentioned being attacked by an owl while walking <br />through the riparian area near the southwest corner of the site. The presence of owls at the <br />site was not mentioned in Exhibit H - Wildlife Information of the permit application. <br />A nesting pair of Great Horned Owls was observed in a willow tree in the southwest corner of <br />the site during the inspection. The Division contacted the Colorado Division of <br />Wildlife(DOW)for recommendations to protect the owls. The DOW representative stated the DOW <br />does not currently have recommended buffer zones or seasonal restrictions for Great Horned <br />Owls, but recommended following the recommendations for Colorado raptors. A copy of the <br />"Recommended Buffer Zones and Seasonal Restrictions for Colorado Raptors" is attached.
